General terms and conditions

Guille's Smile (hereinafter “LSdG”) through its website https://www.lasonrisadeguille.org (in the front, the "Page"), provides duly registered users (the "User" or the "Users") the purchase of personalized items (hereinafter, the "Products") in his Solidarity Store.

The following general terms and conditions (hereinafter the "T&C") develop the particular conditions that regulate the relationship between LSdG and the User for the use and access of the User to the Page and the purchase of the products.

1. Introduction

LSdG is a Non-Profit Association, with registered office at Calle Goleta 8, 28891, Velilla de San Antonio (Madrid) with NIF G87412672 and registered in the National Registry of Associations Group 1, Section 1, Number 609646. The Association has a center qualified as a Special Employment Center with number 396/CM located in Mejorada del Campo (Madrid).

These T&C have been prepared in accordance with the provisions of Law 7/1998, of April 13, on General Contracting Conditions; Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and other complementary laws; Law 7/1996, of January 15, on the Regulation of Retail Trade; Law 34/2002, of July 11, on Services of the Information Society, as well as many other legal provisions that are applicable to the activities of LSdG and the Page.

When Users access the Page and, where appropriate, purchase the products offered by LSdG, the User accepts each and every one of these T&C, the Privacy Policy and Cookies Policy, as well as these Purchase Conditions.

If you accept the T&C, you declare and guarantee that

• Accounts with sufficient legal capacity to link in your own name or in the name of your company or entity, 
• You have read and understood these Conditions and, 
• You accept them on your own behalf or on behalf of the company or entity you represent. If you do not have the necessary legal capacity to accept said link, you cannot continue with the contract.

2- Access to the Store

Access to the "Shop" area is an exclusive service, intended only for registered and active LSdG Users. By clicking on the "REGISTER" button displayed as part of the contracting process, the User accepts the T&Cs set out in these Conditions.

A User will be considered active once they have registered through the procedures established on the Page and there is confirmation of the contractual link by sending registration confirmation to the email address indicated during the User registration process.

The User acknowledges being over eighteen (18) years of age (with the exception of emancipated minors) and accepts that the access and use of the Page and/or the contents included in it takes place freely and consciously, under their sole responsibility.

The access and contracting process, terms and conditions of the provision of services by LSdG will be subject to what is established at any time on the Website.

Likewise, the User, when contracting the provision of services by LSdG, expressly undertakes to provide truthful and lawful information, assuming for these purposes all damages, of any kind, that the untruthfulness or illegality of the data provided by you may directly and/or indirectly cause LSdG and/or any third party, at any time, for any reason, by any means and/or form.

3- Access Keys

LSdG will provide an identifier and an access code to the User, of a personal and non-transferable nature, so that the User can use the Solidarity Store offered by the Page. The User undertakes to preserve their confidentiality, not facilitating the use of their own username and access password to third parties, and assuming, therefore, all kinds of consequences derived from the aforementioned breach of said obligation. The access code may be modified at the request of either party. In the event that said modification takes place at the express request of LSdG, the User will be notified of the date of deactivation and replacement of the access code with a new one.

LSdG is not responsible for any damages or benefits not obtained or caused to the User and/or any third party, as a result of the loss or theft of the username and password and/or as a result of its use by a third.

4- Prices

All the prices of the products are included together with the rest of the description of the products, being publicly accessible, without the need to be registered as a user.

Prices are shown with and without taxes included in the product descriptions.

During the purchase process, the Page will detect the location of the User and at the end of the process will show the final price with Value Added Tax (VAT) applicable in Spain or in their location at the time of purchase, without prejudice to the fact that the user will have detailed information on the price of the product at all times.

In the case of offers or promotions, the prices indicated for each product are the prices applicable to the marketing of said product in each specific promotion, taking each promotion individually as a reference, and not guaranteeing by LSdG that the prices indicated will be equally applicable in other similar promotions carried out at another time.

If you are interested in a product that does not appear as available, you can contact us and we will inform you of the date of entry into our warehouses. In the same way, if you need larger quantities than those offered on our Page, you can contact us and we will inform you of the price.

5- Scope of operation of the page

The page www.lasonrisadeguille.org provides its services throughout mainland Spain, the Balearic Islands and peninsular European Union countries. We do not serve orders from islands, except the aforementioned Balearic Islands.

The delivery times in the peninsula are 24-48 hours from the confirmation of the order for the Iberian Peninsula. For other destinations please consult.

This mode of delivery is associated with certain shipping costs, which may be borne by the user depending on the amount of the order placed.

The information regarding the delivery date will be clearly indicated to the user on the Page at the time of choosing the method of transportation during the purchase process. In any case, LSdG will put all its efforts and dedication to deliver the products purchased on the date indicated. However, in the event of exceptional circumstances or force majeure that are beyond the control of LSdG and that prevent the supply of the products within the indicated period, to the extent permitted by applicable law, LSdG may not guarantee said delivery period, especially when the user resides in populations that are difficult to access or are at high risk. However, it is made known that LSdG will in any case make the best efforts to deliver the products within the scheduled period.

Regardless of the shipping option selected, the return procedure will be the same in all cases, as described in these Contract Conditions.

6- SecurityIn order to manage your purchase on our Website, we inform you that your data will be processed by us following the data protection guidelines that we carefully apply. The purpose of the processing is to manage the purchase you make on our site, the management of the relationship with you as a user of LSdG and, where appropriate, to send you our newsletter with news of our products. It is very important for us to protect the data of our clients in an adequate way and above all that you have all the information about how we use your data, therefore, if you have any doubts about this aspect, do not hesitate to contact us at the association mail @lasonrisadeguille.org.

This is a secure site. All the information you send to the server is encrypted and cannot be interpreted by anything other than LSdG. All the data that we request will be treated with the utmost confidentiality in accordance with the LOPD

7- Return policy

RIGHT OF WITHDRAWAL

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the following informs users of the following aspects:

All users can exercise their right of withdrawal within a maximum period of 14 calendar days from the moment the product was received, and must be exercised directly against LSdG and must follow the following steps in any case:

1- The User must notify LSdG of their desire to exercise their right of withdrawal, by writing to asociacion@lasonrisadeguille.org

2- The User must assume the direct costs of the return, informed in any case by LSdG during the process. Likewise, any possible damage or deterioration of the product during transport and the derived responsibilities will be assumed by the user.

3- Any product that you want to change or return must be in its original packaging, labeling and packaging and must not have been tampered with, the material must be returned in the same state in which it was purchased, this will be verified by LSdG staff.

4- Once the request to exercise the right of withdrawal is received, the system will send an email confirming that it has received the request. Subsequently, it will proceed to refund the economic amount paid (including, where appropriate, the delivery costs and less the direct costs of the return in case the transport offered by LSdG has been used) within a maximum period of 14 calendar days from the moment of receipt of the application for the right and receipt of the purchased product. In any case, the payment of the economic amounts will be made through the means used by the user to make the initial payment, unless the User states a different one and in which case additional costs may be incurred.

5- In the same way and in accordance with the provisions of current regulations, it will not be possible to exercise the right of withdrawal in those cases in which products made according to the consumer's specifications or clearly personalized are purchased, or that, by their nature, do not may be returned or may deteriorate or expire quickly. Likewise, it will not be possible to exercise the right of withdrawal when the products that are already unsealed are not suitable to be returned for reasons of health protection or hygiene.

8- Applicable law and dispute resolution

These Conditions of Use are governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user's domicile.

To present claims in the use of our services, the User can write to the email address asociacion@lasonrisadeguille.org, committing us to seek an amicable solution to the conflict at all times.
